Terms and Conditions
These Terms and Conditions ("Terms") govern your access to and use of this website, including the purchase and use of digital products such as Joomla templates, WordPress themes, Joomla extensions, and related services.
By accessing this website, creating an account, or purchasing any product, you agree to be legally bound by these Terms. If you do not agree, you must not use this website or our products.
1. Definitions
- Marketplace – this website and all related services.
- Seller, we, us, our – BORCAN CRISTIAN PERSOANĂ FIZICĂ AUTORIZATĂ, operating under the commercial name Windstripe Themes.
- User, you, customer, buyer – any individual or entity using this website.
- Products – digital goods including Joomla templates, WordPress themes, extensions, files, updates, and documentation.
- License – the usage rights granted to you upon purchase.
- Support Period – the time during which support services are available (6 or 12 months depending on purchase).
2. Eligibility and Account Registration
To purchase products or access certain features, you may be required to create an account. You must provide accurate and complete information and keep your account details secure. You are responsible for all activity under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Digital Products and Delivery
All products sold on this website are digital and delivered electronically. No physical goods are shipped. Once payment is confirmed, products will be available for download through your account or via a secure download link.
Delivery Time: Products are typically available for download immediately after payment confirmation. In exceptional cases, delivery may take up to 12 hours.
Payments are processed securely through Paddle (paddle.com), our authorized payment provider. Paddle acts as the Merchant of Record for all transactions and is responsible for payment processing, VAT collection, and buyer receipts.
4. Right of Withdrawal and Digital Content Consent
Under EU Directive 2011/83 and applicable Romanian law (OUG 34/2014), consumers have the right to withdraw from a contract within 14 days of purchase without giving any reason.
However, this right of withdrawal does not apply to digital content that is not delivered on a physical medium, where the performance has begun with the consumer's prior express consent and the consumer has acknowledged that they will thereby lose their right of withdrawal.
By completing your purchase, you expressly consent to the immediate delivery of the digital content and acknowledge that you will forfeit your right of withdrawal once the download or access to the product has been made available to you.
This consent is recorded at the time of purchase. If you have not yet accessed or downloaded the product, you may contact us to request a cancellation and potential refund, which will be reviewed on a case-by-case basis.
5. Licensing and Usage Rights
When you purchase a product, you are granted a limited, non-exclusive, non-transferable license to use the product according to the license type selected at checkout.
Ownership of all products remains with us. You are purchasing usage rights only.
6. License Types
Regular License
- Use on one (1) website only
- Website may be personal or commercial
- No redistribution or resale of the product files
Commercial License
- Use on up to five (5) websites
- Websites may be owned by you or your clients
- No resale or distribution of source files
Extended License
- Use on one (1) website
- May be included in a single final product created for a client
- End users may be charged for the final product or service
- Product files may not be redistributed separately
You are responsible for selecting the correct license. Misuse of a license constitutes a breach of these Terms.
7. Prohibited Uses
You may not:
- Resell, share, sublicense, or distribute product files
- Offer products as part of a competing marketplace
- Claim ownership or authorship of the original products
- Remove copyright or licensing notices
- Use products in any illegal or unlawful manner
8. Support Services
Support is provided according to our Support Policy. Support periods available are 6 or 12 months, depending on your selection at the time of purchase.
Support includes help with template features, configuration, and product-related issues. Support does not include custom development, modifications beyond the template's original features, or third-party software support.
9. Updates
Product updates may include bug fixes, improvements, or compatibility updates. Updates are provided during the active support period. We do not guarantee compatibility with future versions of Joomla, WordPress, PHP, or third-party extensions beyond what is stated in the product description.
10. Installation Services
Optional installation services may be offered separately. Installation covers one website only and is subject to our Support Policy and any applicable service agreement.
We are not responsible for data loss or conflicts caused by existing installations, server configurations, or third-party plugins.
11. Refund Policy
Due to the digital nature of our products and the consent provided at checkout (as described in Section 4), refunds are not automatically granted once the product has been made available for download or access.
Refund requests are reviewed on a case-by-case basis. Refunds will not be granted for:
- Change of mind after download or access
- Lack of technical knowledge
- Incompatibility with third-party plugins or hosting environments
- Failure to read product descriptions or requirements before purchase

12. Payment Processing
All payments are processed by Paddle (paddle.com), which acts as the Merchant of Record. By completing a purchase, you agree to Paddle's terms of service and privacy policy, available at paddle.com. Windstripe Themes does not store or process payment card data directly.
13. Intellectual Property
All products, source code, designs, trademarks, and documentation are protected by copyright laws. Nothing in these Terms transfers intellectual property ownership to you.
14. Warranties and Disclaimers
All products are provided "as is" without warranties of any kind. We do not guarantee uninterrupted operation, error-free performance, or suitability for a particular purpose.
15. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or special damages arising from the use of our products.
Our total liability shall not exceed the amount paid for the product giving rise to the claim.
16. Termination
We may suspend or terminate your account or license if you violate these Terms. Upon termination, you must cease all use of the affected products and delete all copies in your possession.
17. Privacy and Data Protection
All personal data is collected and processed in accordance with our Privacy Policy and applicable data protection legislation, including the EU General Data Protection Regulation (GDPR). By using our services, you consent to the collection, use, and storage of your personal data as described therein.
18. Changes to These Terms
We reserve the right to modify these Terms at any time. Updated versions will be published on this page with a revised effective date. Continued use of the website after changes constitutes acceptance of the revised Terms.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of Romania and, where applicable, the European Union. Any disputes arising under these Terms shall be subject to the jurisdiction of the competent courts of Romania.
